These terms are the agreement between you and Control LaunchPad LLC ("ControlLaunchPad", "we", "us") for using ControlLaunchPad. Please read them: they cover your free trial, how billing works, your data and the rules for texting and calling your leads.
By creating an account, starting a trial or using ControlLaunchPad (the "Service"), you agree to these terms. If you use the Service for a company or other organization, you agree on its behalf and confirm you're allowed to; "you" then means that organization too.
Our Privacy Policy, Refund and cancellation policy and SMS terms are part of these terms. You must be at least 18 and use the Service for business purposes.
- Your team works in a workspace. The person who creates it is its owner, and the owner and the people they allow manage its members, roles, settings and billing.
- Each seat is for one named person. Don't share a sign-in.
- Give us accurate information and confirm your email address. Keep your password safe, and turn on two-step sign-in; we recommend it.
- You're responsible for what happens in your workspace and for the people you invite. Tell us right away at support@controllaunchpad.com if you think an account has been misused.
- Each plan you can sign up for online starts with a 14-day free trial on the plan and billing period (monthly or yearly) you choose.
- A card is required. To check it, we place a temporary authorization hold for one seat's first payment and release it right away. Nothing is charged. Your bank may show the hold as pending for a few days.
- The trial starts when you confirm your email address.
- We'll email you 3 days before your trial ends.
- When the trial ends, your subscription starts and your card is charged automatically for your plan, billing period and seats, unless you cancel before the trial ends. If you cancel during the trial, you aren't charged.
- We may limit free trials to one per business.
- Per seat. Plans are priced per seat. Each active member of your workspace is a seat, and each plan has a maximum number of seats and other limits shown on our pricing page.
- In advance, automatically renewing. Subscriptions are billed in advance for each month or year and renew automatically at the end of each period until canceled. Yearly billing costs 10 times the monthly price per seat.
- Seat changes on monthly billing: a seat you add is charged for the rest of the current month, prorated, and billed at your next renewal with that invoice. A seat you remove comes off at your next renewal, without a credit for the current month.
- Seat changes on yearly billing: a seat you add is charged right away, prorated for the rest of your billing year. A seat you remove comes off at your next renewal, without a credit for the rest of the year.
- Switching billing period: moving from monthly to yearly is charged right away, minus a credit for the unused part of your month. Moving from yearly to monthly takes effect when your year ends.
- Plan changes are made in Billing, which shows the price before you confirm. A bigger plan starts right away, and the difference for the rest of your billing period is charged then. A smaller plan starts at your next renewal, without a credit for the current period.
- Payment. You authorize us, through our payment processor Stripe, to charge your card for all fees when due. Keep your card details current in Billing.
- Promotions. A promo code or discount applies only as described when you use it, and has no cash value.
- Prices and taxes. Prices are in US dollars and don't include taxes. You're responsible for any taxes that apply, and where we're required to collect them, we'll add them to your invoice.
- Price changes. We may change our prices. For an existing subscription, we'll tell you at least 30 days before a new price applies, and it applies from your next renewal after that notice. When you change your plan or billing period yourself, the new plan or period is billed at its current price.
- Invoices are available in Billing.
If a payment fails, we'll email the people who manage billing, and we'll try the card again. Your team keeps working for 7 days. If the payment still hasn't gone through after that, the workspace pauses until it does. Your data is kept while the workspace is paused. If an amount stays unpaid, we may cancel the subscription.
- You can cancel at any time from Billing (Manage billing), or by emailing us from the address on your account.
- When you cancel, your subscription stays active until the end of the period you've already paid for, then ends. It doesn't renew.
- Payments are non-refundable except as our Refund and cancellation policy says. In short: no refunds for part of a month; on yearly plans, a full refund if you ask within 14 days of the yearly charge; for extra AI credits, a refund of the credits you haven't used if you ask within 14 days of buying them.
- After a subscription ends, the workspace pauses and its data is kept, so you can come back, until you ask us to delete it. You can export your leads and deals before then.
- You own your data. The leads, contacts, messages, deals, files and other content you or your workspace put into the Service ("Customer Data") belong to you.
- Our permission to use it. You give us permission to host, copy, send, display and otherwise process Customer Data only as needed to provide, secure and support the Service for you, and as our Privacy Policy describes. We don't sell it.
- Your responsibility for it. You're responsible for Customer Data: that you have the right to collect and use it, that it's accurate, and that you have the consents and notices the law requires for the people in it.
- Usage information. We may use information about how the Service is used, in aggregate and without identifying you or the people in your Customer Data, to run and improve the Service.
- Exporting. You can export your leads and deals to CSV at any time, and ask us for a full export of your workspace.
You're responsible for how you and your team use the Service. You agree to:
- Get consent before you text or call. Follow the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the National Do Not Call Registry, state telemarketing and texting laws, and the rules in other countries you contact, such as Canada's anti-spam law (CASL). Get the consent each law requires, written where required, before sending automated or marketing texts or making calls.
- Follow email law. Follow CAN-SPAM and similar laws: honest sender details and subject lines, a valid postal address in marketing emails, and a working way to unsubscribe.
- Honor opt-outs. Respect STOP replies, unsubscribes and do-not-contact requests on every channel, and don't re-add people who opted out without fresh consent.
- Follow carrier rules. Register your texting numbers with US carriers (10DLC) through your own Telnyx account, keep that registration accurate, and follow the carriers' and the CTIA's messaging rules, including their limits on certain content.
- Follow call-recording laws. If you record calls, give the notices and get the consents your state and your callers' states require.
- Treat people fairly. Follow fair housing and anti-discrimination laws in your messages, listings and lead handling.
You agree not to:
- send spam, or messages that are unlawful, deceptive, harassing, threatening, hateful, sexually explicit or that infringe someone's rights;
- use purchased, rented or scraped contact lists to send texts or emails;
- upload malware, or try to break into, probe, overload or disrupt the Service or other customers' workspaces;
- go around plan limits or the API's rate limits (120 requests a minute per key), or copy, resell or reverse engineer the Service;
- use the Service where the law doesn't allow it, including in breach of export controls or sanctions.
Our opt-out handling, sending hours in each lead's time zone, do-not-contact list and carrier registration help make compliance easier, but they're tools, not legal advice, and they don't make your messages compliant on their own. You remain responsible for the messages and calls you and your automations send.
- Texts and calls go out on your behalf, through the provider your workspace uses.
- Telnyx. If you connect your own Telnyx account, you have your own agreement with Telnyx, and Telnyx bills you directly for numbers, messages and registration fees. We show you those fees before you agree to them.
- Twilio. Where ControlLaunchPad connects texting and calling for you, the phone numbers stay with us and our provider, and may be released after your subscription ends.
- Carrier decisions. Carriers and The Campaign Registry decide whether to approve your registration, and they may filter, delay or block messages. We aren't responsible for their decisions or for messages they don't deliver.
- Not for emergencies. Calling in ControlLaunchPad isn't a replacement for a phone service. Don't rely on it to reach emergency services.
The Service works with services we don't control, such as Telnyx, Twilio, Stripe, Google, Microsoft, Meta, Zapier and any app you connect with our API or webhooks. When you connect one, its own terms and privacy policy apply to your use of it, and you let us exchange data with it on your behalf. We aren't responsible for third-party services, and if a provider changes or stops its service, we may have to change or stop that integration.
Some features use AI to write lead briefs, drafts, reply ideas, call summaries, the morning briefing and answers to questions about your data. AI output is generated automatically and can be incomplete or wrong. Review it before you rely on it or send it: you're responsible for what you send. It isn't legal, financial or other professional advice. Our Privacy Policy explains what data these features use.
Credits
- Monthly credits. Each plan includes a number of AI credits per active seat each calendar month, as shown on our pricing page and in Billing. The workspace shares them. They reset at the start of each month (UTC), and monthly credits don't roll over.
- What uses credits. Features you ask for use credits: for example, "Draft for me" uses 1 credit and an AI report (Ask your CRM), on plans that include it, uses 3. Background features, such as lead briefs, reply ideas, the morning briefing and call wrap-ups, don't use credits.
- Free trial. During a free trial, AI is limited to 30 credits per seat a month, whatever plan you trial.
- When credits run out, features that use them give built-in suggestions instead until your credits reset or you add more. The rest of the Service keeps working.
- Extra credits. On plans that offer them, you can buy extra credits (currently 1,000 for $25) as a one-time purchase. They're used after your monthly credits and carry over from month to month while your subscription is active. Bought credits are non-refundable once used, and any left expire when your subscription ends. They have no cash value and can't be moved to another workspace. See our Refund and cancellation policy.
Fair use
Background AI is included within fair use, currently 300 background requests per seat a month; past that, built-in suggestions are used until the next month. Don't use AI features to get around plan limits or in a way that harms the Service or other customers. We may limit AI use that does.
Changes
- We may change how many credits a feature uses, the credits a plan includes or the fair-use limit. If a change reduces what your plan includes, we'll tell you at least 30 days before it applies to your subscription.
- Owners and admins can turn AI off for the workspace. Built-in suggestions are used while it's off, and when our AI provider is unavailable.
- Features we describe as coming soon aren't part of your plan until we release them, and their details may change before then.
- We work hard to keep the Service available, but it may sometimes be unavailable or read-only, for example during maintenance or a provider's outage. Unless we've agreed otherwise in writing, we don't promise a specific uptime.
- You can reach our team from the Help button in the app or at support@controllaunchpad.com. Business and Enterprise plans get priority support.
- We improve the Service all the time and may add, change or remove features. If we remove a feature that's a significant part of your paid plan, we'll tell you in advance.
We own the Service, its software and design, and the ControlLaunchPad name and logo. While your subscription is active, we give you a limited, non-exclusive, non-transferable right to use the Service for your business under these terms. These terms don't give you any other rights in it.
If you send us ideas or suggestions, we may use them without any obligation to you.
- We may suspend or limit a workspace, or a user, if a payment is overdue past the grace period, if we reasonably believe these terms or the law are being broken (for example spam, missing consent or carrier complaints), or to protect the Service, our customers or the public. Where it's practical, we'll tell you first and give you a chance to fix the problem.
- We may end these terms for a serious or repeated breach, or with 30 days' notice for any other reason; if we end them for any other reason, we'll refund any prepaid fees for the time after the end.
- You may end these terms at any time by canceling your subscription.
- When these terms end, your right to use the Service ends. What happens to your data is described in our Privacy Policy. Sections that by their nature should continue (such as your data, disclaimers, limits of liability, indemnity and governing law) continue.
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free, that messages will be delivered, that carriers will approve a registration, or that you'll reach any particular result with your leads.
To the fullest extent the law allows: neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, even if told they were possible; and our total liability for all claims about the Service or these terms is limited to the fees you paid us for the Service in the 12 months before the event that gave rise to the claim.
These limits don't apply to your payment obligations or your indemnity below, or where the law doesn't allow them.
You'll defend and indemnify us, and our officers, employees and agents, against claims, losses and costs (including reasonable legal fees) arising from your Customer Data, the texts, emails and calls you or your automations send, including claims under the TCPA and similar laws, or your breach of these terms or the law.
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute about them or the Service will be heard in the courts located in Sheridan County, Wyoming, and both parties agree to those courts' jurisdiction. Before going to court, please email us so we can try to resolve it together.
We may update these terms. If a change is significant, we'll tell account owners by email or in the app at least 30 days before it takes effect. If you keep using the Service after that, the new terms apply; if you don't agree, cancel before they take effect.
- These terms, with the policies they include, are the whole agreement between us about the Service, unless we've signed a separate agreement (such as an Enterprise order form), which then takes priority where they differ.
- You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets.
- If part of these terms can't be enforced, the rest still applies. Not enforcing a right isn't a waiver of it.
- Neither party is responsible for delays caused by events beyond its reasonable control.
- We'll send notices to the email address on your account. Send notices to us at support@controllaunchpad.com and, for legal notices, also by mail to Control LaunchPad LLC, 30 N Gould St, Ste 62372, Sheridan, WY 82801, United States.
